Turning a Murder over to Justice

On December 30th, 2023, Keith Jhay Frierson, affectionately known as KJ, helped his mother, Brittani Frierson, bring in groceries. He then asked to go outside to ride his bike, which he recently got for Christmas. While riding bikes with other children, KJ innocently and carefreely celebrated winning a bike race. This angered another child, Arkete "Arcade" Davis, who went to his Arkete Davis’s unlocked vehicle and got a gun. He walked over to KJ, raised his arm, and shot him. The bullet entered the front of KJ's neck, just below his chin, traveled upward, then out the base of his skull, killing him within seconds. Arkete "Arcade" Davis then said, "see I told you my daddy had a gun." He then expressionless pointed the gun at another child. Witness said he looked like he didn’t care that he shot him The father and son put the gun into a residential Sacramento County Garbage Can, leaving KJ in a pool of blood and still on his bike. Neighbors, children, emergency responders, and the hospital refused to give up and tried to revive KJ, although he was already gone. The shooter, Arkete "Arcade" Davis, was arrested for murder and was taken to the Sacramento County Youth Detention Facility but was immediately released to his family as the DA declined to charge him with his crime, stating that the 10-year-old did not know right from wrong and didn't know what he was doing when he picked up the Glock, pointed it upward at KJ, pulled the trigger, and fired it at close range. The Davis family had multiple reports to Sacramento County Child Protective Services. The father, Arkete Davis, also known as DELOC, a 74th CRIP, who is a felon with a strike from committing armed robberies, was not supposed to be in possession of a gun. Arkete "Arcade" Davis has a reputation for being a "bad kid"; he would often pretend to shoot kids while outside. Arkete Davis unprovoked has also become aggressive with multiple women, including the President of the HOA. During the first court hearings, Arkete Davis’ mother, Glenda Collins, gave intimidating looks to KJ’s grandmother, mother, aunt, and godmother. After the second court hearing, Glenda Collins verbally attacked KJ’s grandmother and mother, trying to provoke a physical altercation while KJ’s mother was on the phone with the DA’s office. At the 3rd court date, the looks continued when Glenda Collins was asked to stop and was told, "Your grandson killed our nephew." She started yelling profanities. It is not lost that teens that also lived in the home are a part of the Juvenile Justice System, and there have been prior police present at that home. However, the DA chose to ignore the law and send that child back into society without any recourse, discipline, counseling, or any supportive services. He has changed the victim and witness families forever. Children in the community are scared to come outside and play. That fear has become paralyzing for neighbors and their children since the father, Arkete Davis, has posted bail and returned to the home. We had to seek a no-contact order. As it stands, Arkete Davis may face 6 years in prison, but he will only serve 50% of that because his crime is considered nonviolent. California law prevents his mug shot from being displayed, although his negligence as a human being and father and blatant disregard for the law resulted in KJ’s life being taken before it could begin. Arkete "Arcade" Davis has returned to school and is free to be around other children with no recourse, correction, discipline, reprimand, or supportive service. He is being taught a lesson that it is okay to take someone’s life because you were upset. He is blatantly being allowed to get away with murder. We were all children at one point; we were all able to ride our Christmas bikes, and we were all corrected when we did something wrong. Arkete "Arcade" Davis took KJ’s life for no reason. KJ was in the right place, doing the right thing. This was not two children playing with a gun. As a people, we have to understand that times are different; we have to understand that by not teaching children that there are consequences when you do not follow the rule and allow justice to not be fully served, you are setting an impression for not only the murdered but other children involved or just hearing it discussed at school. 10-year-olds are overly exposed to things that we were not as children. These are not the 10-year-olds we were. Juveniles are committing violent and aggressive acts daily, and it is being overlooked. How many victims will it take for proper recourse, behavioral support, or discipline? Science suggests a specific age for understanding long-term consequences and being able to use mature rationality, but that doesn’t mean there was a lack of intent, which is a crucial and key element to charge a criminal with a crime. Murder is one of the five crimes a minor under 12 can be charged with; his intent to harm is evident in this situation and others that transpired before this. This wasn’t two kids playing with a gun; this was a child that was upset and due to his nature and environment knew where to find a gun, knew how to fire it, and the context to use it in. KJ was murder, his death is list as a homicide. We are demanding that CPS investigate the entire household; we are demanding action from our Justice system and our elected DA to charge the child shooter, Arkete "Arcade" Davis, be charged as legislation supports charging a 10-year-old minor if they commit murder. We are also asking that our legislators change the laws to support victims of gun violence, ending gun violence by posing longer sentences and higher bails for crimes committed with the use of stolen guns and gun crimes committed by prohibited persons. We also demand the DA to look into his gang affiliation.
