The probation service part 10

March 2010. The pain, of which I have never experienced the like of before was debilitating. I couldn't stand up, I couldn't sit down, I knew this was a hospital job. A good dose of Morphine later and everything was good again, and a little floaty.

It turned out I had a kidney stone. The consultant explained there are many causes; too much salt, too much alcohol but the most common is stress. It was clear that the past 3 years were starting to take their toll on me. I remembered at some point during my stay in Hospital that I had a prearranged appointment with Buckley. I also remembered she had said if there was a problem attending, as long as I notify her in advance it “should” be ok.

 

My father contacted The SOMU unit (Sex offender management Unit) to inform the DC who was “looking after” me, about the current situation as a matter of courtesy. Danielle Buckley was contacted. Quick game; I like games. Choose (A) if you think Buckley said “Thanks very much, no problem, we'll re-arrange”. Choose (B) if you think Buckley managed to sink even lower. Pat on the back if you chose B. Re read parts 1-10 if you chose A.

 

You may have broken the law, the conditions of your licence and or the requirements of the sex offender register”. “Say whaaat?” I recall thinking. Buckley explained that because I was on the sex offenders register and my licence conditions state that “ you must inform your offender manager of any change of address” and “only by prior approval of your offender manager “, I may have breached those conditions. I know, I know, stay with me. Lets go on a little adventure. I was in hospital because of what I believed at the time was a medical emergency. I was heavily sedated for almost five days and My address is not “the hospital”. “Ah but it is” explained Buckley, “because you have stayed in a place other than your notifiable address, for more than two nights, by law you should have informed the police and me so that a risk assessment can be done at the hospital”. At the risk of sounding stupid, I was completely stumped. I did not have a scooby doo what she was talking about. Buckley explained that because I am a sex offender, and “pose a risk of serious sexual harm to children”, that when I am in a place like a hospital I must notify them because I may or may not have access to children. I would like to think that some of you reading this will think “WTF? Seriously? Or even; is she for real?” Sadly she was for real, fortunately she is a probation officer not a brain surgeon or scientist or in charge of dangerous machinery like a knife and fork for example, or any job requiring intelligence, something we should all be quietly grateful for. Should any of you find yourself in the postion of hearing the following; "Good afternoon ladies and gentlemen, this is your captain Danielle Buckley speaking....."  Disembark.....Quickly.

 

Buckley discussed it with her superiors and she decided not to take any further action. What you can glean from this are three things; 1) Buckley was clearly looking for any reason to recall me as she had previously threatened. 2) She realised that being rushed to hospital with pain so bad it requires morphine, does not allow a patient chance to stop the doctor in the hallway and say “Excuse me kind sir, I'm a sex offender, can you raise the royal standard outside, sound the alarm, lock all the children away and contact super Buckley?”. 3) Her superiors said “are you for real?”.

 

I returned home and within a few days had my next appointment in Bury. In this meeting Buckley asked me again about the location of my wife and son, I again refused to answer, she again threatened me that if I didn’t.......yawn. This time however, Buckley began asking questions about my childhood;

 

(Buckley=B K=me)

 

B “So Kristian, can you tell me about your childhood, where you grew up, was it happy...?”

K “my childhood was fine, what has that got to do with anything?”

B “ I need to ask questions about everything leading up to your offence, which may give an indication as to why you attacked your victim”

K “First of all, there was no offence, second of all the only victim is me, thirdly I do not wish to discuss any aspect of my life private or otherwise with you. I have already told you that”

B “And I've already told you, you have to answer, and I’m going to keep asking the questions”

K “well I won't be answering any questions about my family. I will discuss the case with you that is all”.

 

B “well you're in denial, your refuse to accept responsibility for your offence and you're extremely paranoid, so what am I supposed to do with you, we're supposed to discuss something in these sessions!”

 

K “I will not discuss my family or anything but the case with you, because I don't trust you, you are a liar and you are also working with Barnard”

B “yes I've heard about that” (Buckley refers to the complaint we made to Brimley re Barnard and Buckley, at least we know he read it!), I want to make it quite clear that I am not in anyway working with DS Paul Barnard and you need to let go of this obsession with him”

 

I wonder why Buckley felt the need to deny it so forcefully? Still at least we had proof in the form of the freedom of information request, Oh and GMP confirming it to be true.

 

K “well we have proof, and I will not give up on Barnard until he and everybody else who has had any part in this, no matter how big or small is brought to justice

B “ Does that include me?” Buckley gave a smug grin

K “Everybody. As a matter of fact I'm currently writing a book about it, naming and shaming everybody”

B “well you could face charges of libel”

K “ Everything I say can and will be backed up with evidence, I'd welcome a day in court.

 

Buckley tried to steer the conversation back to my childhood and asked why it was that I hated Barnard so much. I began to tell her the story of what he'd done . Buckley stopped me and changed the subject again, clearly uncomfortable with the truth. I wonder if somewhere in that head of hers, she thought “What have I done? What have I been a part of for all this time? Barnard has lied to me and made me look very silly”

 

Whilst at Littleborough I had a partner, as in a work partner, police partner. She was a very special person to me, I trusted her with my life and she trusted me with hers. I was honoured to work alongside her. That of course is only in a professional sense. For the purposes of this article I will refer to her as “PC x”

 

B “so tell me about your relationship with pc x....”

 

A bolt out of the blue, as you can imagine

 

K “She was my partner for almost four years”

 

B “was it sexual?”

 

K “Excuse me?”

 

B “was it sexual? I mean its not normal is it?”

 

K “what isn't normal? You've lost me”

 

B Well a male working with a female for that amount of time, its not normal, normally in a male dominated environment men work with men”

 

As I sat and listened to this nonsense, I was stunned at how ignorant Buckley was, how out of touch with reality she was and how she was now apparently a fully qualified psychologist, not just a probation officer. Sorry, “offender manager”

 

K “not that its any of your business but it was a strictly professional relationship, its perfectly normal and what on earth has this got to do with anything?”

 

B “have you ever had an affair?”

 

I was beginning to wonder if I was speaking a different language or I had stepped into an alternate reality. Then I remembered its just another week with Buckley. This sort of behaviour form her, this sort of interrogation had been going on since we had first met, and to what end?

 

K “OK, I’ve obviously not made myself clear enough, I will not discuss with you any aspect of my life my family, my friends, nothing. If you want to discuss the case that’s ok, nothing more.”

 

B “ As part of my job I need to profile you to prevent any further attacks by you, to think about who your next victim might be and try to protect them, In order to do that I have to ask you certain questions”

 

What do you say to that? What possible answer can you give to that? It seems beyond me that somebody can be so far from reality and the truth. I accept that there are a lot of people in society that the public need protecting from, I used to work with them (or for them depending on your view). I also accept that in order to protect the public, people like Buckley must ask questions, find out who you are, what you are about and therefore come up with some idea about when, if at all you may pose risk to the public. I get all that, and in many ways I support it. What I cannot understand and has baffled me for all of the past four years is this; If somebody sits in front of me, and says “I am innocent” my view, and I am by no means a professional, would be to say ok, lets look at the case. Here is ten reasons why I think you are guilty. I would then ask the person to explain to me how the evidence was wrong, or prove to me why they are innocent. I would then look at the case and if there is genuine merit in what the person was saying, I would ask questions of the police.

That of course is why I was a never a probation officer, I can think for myself, reason, argue, discuss. That’s not their job though. They are “not there to judge on guilt” said Roz Hamilton, their very own assistant chief officer. This is the point that I have been unable to make the Probation service understand. Buckley had judged me, she had decided I was guilty and no matter what happened after that, it was her mission to make me suffer.

 

The meeting concluded and I went back home left dumbfounded. Buckley arranged the next appointment which was to be at my home address. I unfortunately have to take you back in time again to remind you of two things Buckley has said about me;

 

  1. you are high risk because you like young girls, you are a predatory sex offender, we need to think about your next attack or who your next victim might be”

  2. As part of my job I need to profile you to prevent any further attacks by you, to think about who your next victim might be and try to protect them, In order to do that I have to ask you certain questions”

 

 

 

 

Danielle Buckley was now asking to be on her own with me at my address, a “high risk sex offender” a “Predator” no less. There was no way I was going to be on my own with her, knowing the damage she could do. A family relative who knew of the situation said she would be more than happy to sit with me whilst Buckley was there. Buckley had remained adamant I must be on my own and could not have any legal representation present at any meeting with her (no witnesses). There was no way Buckley was going to dictate to me who I can and can not have in my own home.

The door bell rang and sure enough, there was Buckley on her own. I wish I could have recorded the change in her face when she saw there was somebody else present.

 

B “ Shall we go in the other room?” Buckley enquired

 

K “ Nope, here's fine, they are friends of mine and they know everything about the case”

 

I think gutted would adequately describe Buckley. The meeting went very well, Buckley was very polite, I asked her questions she answered them and left, no bullying, harassing, weird probing questions, nothing. I wonder why?

 

I had several more meetings with Buckley each one lasting at least an hour at Bury, in the same vein, probing questions, weird questions and nothing whatsoever to do with the case itself. It was during the course of all these meetings I began to see that I was the only person who was kept for an hour. In the rooms around me, week in week out I saw the same people go into the rooms with their probation officers and leave after ten minutes, all happy, all smiling all pally with their offender managers. What was so special about me that required an hour?. We wrote yet another letter to John Brimley asking him to explain why I appear to be the only person kept for an hour every time. He of course declined to answer but the next time I went in. I was only kept for twenty minutes. After the letter to John Brimley I was never kept for more than half an hour again. Strange that.

 

What was the fascination Buckley had about me? She wanted to know where my wife and son were, details of my Appeal which I refused to give, and constantly questioned me about what I like, don’t like, my private business. It was just weird. Was Barnard forcing her to ask questions? We know Buckley was reporting back to him. Was it the Social Services trying to get information form me via Buckley? She was also reporting back to them. Or was it just that she simply could not handle not being in control of me? I don't suppose I'll ever know.

 

What I can tell you, is that one of the meetings with Buckley, she could not be present and I had a “stand in” who, in the five minutes I was with her did more for me than Buckley had done in almost two years.

Judicial Review Refused
